3. Where we get information

4. How we use information

We use every category in Section 2 for any of these purposes:

If we want to use personal information for a purpose that is materially different and not compatible with these, we'll tell you first and, where the law requires, ask for your consent.

5. Wholesale price inquiries

Retail and wholesale buyers can ask toy makers listed on ToyDirectory for wholesale prices. When you send an inquiry, we collect your name, company, email, phone, store type, location, the products you're interested in and your message. We send your inquiry to the maker or makers you choose so they can reply. Sending your inquiry to the makers you choose is a disclosure you direct, so it is not a "sale" under California law.

Each maker uses your information under its own privacy policy. We require makers to use it only to answer your inquiry and for related business follow-up, not to resell it, and to honor opt-outs. We can't control what makers do, and we can't promise any maker will reply.

We also keep your inquiry details and use them for the purposes in Section 4. We don't currently sell them to anyone other than the makers you choose. If we start, it will be under Section 6, and you can stop it at any time with Do Not Sell or Share.

6. Who we sell, share or disclose information to

What we sold or shared in the last 12 months. In the last 12 months, the only "sharing" was for cross-context behavioral advertising through Google AdSense: online identifiers (such as cookie IDs and IP address) and internet activity (such as pages viewed) were shared with Google, which uses them to show and measure ads, including personalized ads. We did not sell any personal information in the last 12 months.

Disclosures for business purposes in the last 12 months. We disclosed identifiers, contact details, commercial information and communications to our service providers listed below, for example to process payments, host the site and send email.

Our right to sell or share in the future. We reserve the right to sell or share information you give us or that we collect on our sites, in any category in Section 2 except sensitive personal information, with these categories of third parties:

We won't sell information we got only from public or third-party sources. Before we start selling, we'll update this policy, and every choice in Section 7 will apply.

If we sell personal information, each buyer must first sign an agreement limiting what it uses the information for and requiring it to follow California privacy law.

Service providers. We also disclose information to companies that work for us under contract and can't use it for their own purposes, such as website hosting, email delivery, PayPal for payments, Substack for newsletters, Cloudflare for site security, and accounting and legal advisers.

Other disclosures. We may disclose information when the law requires it, to protect rights and safety, and in a merger, sale or reorganization of our business.

7. Do Not Sell or Share My Personal Information

You have the right to tell us to stop selling or sharing your personal information, including for targeted advertising. To opt out:

You don't need an account and we won't ask you to prove your identity, though we may ask for your email or name so we can find your record. We'll act on your request as soon as we can and within 15 business days, and we'll tell any company we sold or shared your information with to stop as well. After you opt out, we'll wait at least 12 months before asking you to opt back in. If you later want to opt back in, you can tell us.

Sensitive personal information. We use sensitive personal information only to provide the Services you ask for and for other purposes the law allows, so we don't offer a separate "Limit the Use of My Sensitive Personal Information" link. We never sell or share it.

8. Cookies, pixels and tracking

We and other companies use cookies, pixels, tags, SDKs and similar tools on our websites and in our emails. These tools collect online identifiers and activity, and the companies that run them may collect information about your activity over time and across different websites and apps, and use it for their own purposes, including advertising. Tools we use or may use:

Your choices: You can block or delete cookies in your browser settings, opt out of personalized Google ads at adssettings.google.com, and use Do Not Sell or Share. Blocking cookies may make some features work less well. To stop email tracking, turn off images in your email app.

9. Global Privacy Control and Do Not Track

Global Privacy Control (GPC). If your browser sends a GPC signal, we treat it as a request to opt out of the sale and sharing of personal information linked to that browser or device, and to any account or email we can connect to it. Where we can, our site shows that your opt-out was honored. You can turn on GPC in browsers such as Firefox, Brave and DuckDuckGo, or with a browser extension. See globalprivacycontrol.org.

Do Not Track. Our websites don't respond to "Do Not Track" browser signals, because there is no common standard for them. We do honor GPC as described above.

10. Your California privacy rights

If you live in California, you have these rights, including if you contact us for your business:

How to make a request: email [email protected] with the subject "Privacy request," or call 424-272-6854 (leave a detailed message). Tell us your request and the email or name we'd find you under. We'll confirm we got it within 10 business days and answer within 45 days. If we need more time, up to another 45 days, we'll tell you why. To protect you, we'll check your identity for requests to know, delete or correct, usually by matching details you give us with what we have, or by email confirmation.

Authorized agents: someone you authorize can make a request for you. We may ask for your signed permission and ask you to confirm your identity with us directly.

Notice of financial incentive: we don't currently offer discounts or other benefits in exchange for personal information.

Shine the Light (Civil Code 1798.83): California customers may ask once a year for a list of the categories of personal information we disclosed to third parties for their direct marketing in the prior calendar year, and the names and addresses of those third parties. Email [email protected] with the subject "Your Privacy Rights."

11. Children

Our Services are for adults and businesses. They are not directed to children under 13, and we don't knowingly collect personal information from children under 13. Some of our videos and gift guides are about toys, but they are written for parents, gift buyers and the toy trade. We don't knowingly sell or share the personal information of anyone under 16. If we learn we have collected information from a child under 13 without verified parental consent, we will delete it. If you believe a child has given us information, email [email protected] with the subject "Child privacy," and we'll delete it.

12. How long we keep information

We keep each category for the period shown in Section 2, or as long as reasonably needed for the purposes we collected it for, and then delete or de-identify it. We keep tax and payment records as long as the law requires. We keep opt-out and unsubscribe records so we can keep honoring them.

13. Emails and unsubscribing

We send newsletters, offers and other marketing emails. Every marketing email has an unsubscribe link and our postal address. We honor unsubscribes within 10 business days. We never sell, rent or transfer the email address of anyone who has unsubscribed from our emails. You may still get non-marketing emails, such as receipts and replies to your inquiries.

14. AI tools

We use AI tools to help write and edit content and emails and to analyze data. Some videos use an AI-generated voice. Some of our emails and messages may be written or sent with the help of automated tools. We may use personal information and content you send us to train, test and improve AI tools, under the choices described in this policy. We don't use automated decision-making to make decisions that have legal or similarly significant effects on you.

15. Security

We use reasonable safeguards for the kind of information we hold. No system is fully secure, so please don't send us sensitive information by email.

16. People outside California

We are based in the United States, and information is stored and processed in the U.S. If you live in another U.S. state with a privacy law, you may have similar rights to know, delete, correct and opt out of sales, targeted advertising and profiling. Use the same contacts above. If we deny your request, you can appeal by replying to our answer with the subject "Appeal."

17. Changes to this policy

We may update this policy. We'll post the new version with a new "Last updated" date. If we make a material change, we'll put a notice on the site and email you if we have your email, before the change takes effect. We won't use information we already collected in a materially different way without telling you first and getting consent where the law requires.
